You are contracting with BESS POC D-1 s.r.o., a company that operates under the trading name "Plenty". You confirm that you are at least 16 years old and, if entering these Terms on behalf of an organization, that you have authority to bind it.

By continuing to use the Service you accept these Terms. If you do not agree, do not use the Service.

Plenty helps you set a daily protein goal and track your intake. It is an educational tracking tool and not medical advice. Always consult a qualified clinician for guidance on your treatment, diet, or medications.

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate information and keep it up to date.
• You are responsible for all activity that happens under your account.

You agree not to:

• Use the Service unlawfully or for fraudulent, spam, or abusive purposes.
• Infringe any intellectual property or privacy rights of others.
• Attempt to probe, scan, reverse engineer, or interfere with the security of the Service.
• Introduce malware, scrape at scale, or overload our infrastructure.
• Resell, redistribute, or circumvent technical limits of the Service.

Plenty and all associated software, content, and branding are owned by BESS POC D-1 s.r.o. or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. All other rights are reserved.

You retain ownership of the content you submit (for example food descriptions and weight logs). You grant us a limited license to host and process that content solely to operate and improve the Service.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, applicable taxes, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically at the end of each billing period until canceled. You may cancel at any time from your account settings or via the Paddle-hosted customer portal. See our Refund Policy for the refund window and how to request a refund.

We work hard to keep Plenty available and accurate, but the Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or that any calculation is suitable for your specific medical needs. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, our aggregate liability to you for any claim arising out of or in connection with the Service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded by law.

You will indemnify and hold BESS POC D-1 s.r.o. harmless from claims arising out of your misuse of the Service, your user content, or your breach of these Terms.

We may suspend or terminate your access to the Service if:

• You materially breach these Terms;
• Your account is past due or a payment is reversed;
• We reasonably suspect fraud, abuse, or a security risk; or
• We are required to do so by law.

You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service ends. We may retain limited information as required by law or as described in our Privacy Notice.

We may modify the Service and these Terms from time to time. We will notify you of material changes in the app or by email. Your continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of the jurisdiction of BESS POC D-1 s.r.o.'s registered seat, excluding conflict-of-law rules. Courts of that jurisdiction have exclusive competence, unless mandatory consumer protection law provides otherwise.

If any provision of these Terms is unenforceable, the remainder stays in force. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our consent. Neither party is liable for delays caused by events beyond their reasonable control.
